What is the difference between declaration suit and title suit?

Declaration suit seeks court declaration of legal rights without necessarily seeking possession, while title suit specifically seeks declaration of title along with possession of property. Declaration is broader and can cover various legal rights.

Can I file declaration suit for future rights?

No, declaration suits can only be filed for existing present rights that are under dispute or cloud. Future or contingent rights cannot be subject of declaration suits under Section 34 of Specific Relief Act.

Is it necessary to implead all interested parties?

Yes, all persons who have interest in the subject matter or may be affected by the declaration must be impleaded as parties. Failure to implead necessary parties can result in suit dismissal.

What happens if defendant does not contest the declaration suit?

If defendant does not file written statement or contest the suit, court can pass ex-parte decree. However, court must still be satisfied that plaintiff has made out a case for declaration based on evidence.

Can declaration suit be combined with other reliefs?

Yes, declaration can be combined with other reliefs like injunction, possession, damages, or specific performance if they arise from same cause of action and are legally permissible.

How long is the limitation period for declaration suits?

Generally 3 years from when the right is disputed or put under cloud. For property title declarations, it may be 12 years. Limitation varies based on the nature of right and specific circumstances.

What if my declaration suit is dismissed?

If declaration suit is dismissed, you can file appeal in higher court within 30-90 days depending on court level. You can also file fresh suit if dismissal was on technical grounds and cause of action still exists.
